In Texas, authorities detained an 18-year-old mother for reportedly placing her newborn baby in a garbage bag and discarding it in a dumpster. She claimed to law enforcement that she felt compelled to do so to prevent her boyfriend from ending their relationship.
According to court documents examined by Law&Crime, Everilda Cux-Ajtzalam was arrested on Thursday and accused of a single charge of feloniously deserting a child with no intention of coming back.
In a legal document presented in the District Court for Harris County, it is alleged that on July 21, 2024, Cux-Ajtzalam gave birth “on the ground behind the food truck where she is employed” and proceeded to place the newborn, identified as “John Doe” or “CW” in the records, inside “a securely fastened garbage bag” before abandoning him in a dumpster located in the 6000 block of Dashwood Drive in Houston, Texas.
In a bond order, a magistrate judge described how the defendant placed the baby, placenta, and umbilical cord in a garbage bag, carried it to a dumpster, and abandoned the baby inside the dumpster, secured within the bag.
Afterwards, a passerby near the trash bin caught the sound of the baby’s cries and dialed 911. Around 1:15 p.m., Houston Police Department officers and medical responders swiftly arrived at the scene to rescue the child found inside the dumpster.

In the realm of medical assistance, the Houston Fire Department’s skilled medics conveyed the injured individual to Texas Children’s Hospital for medical care. Officials reported that the child was in a stable state and in good health. Once he received medical attention, he was entrusted to the care of Child Protective Services.
The police swiftly linked the newborn to the food truck and located Cux-Ajtzalam. In her initial court appearance, Cux-Ajtzalam, a citizen of Guatemala, faced the scrutiny of Judge Veronica M. Nelson from Harris County District Court for abandoning her son to perish amidst a pile of trash, as detailed in a Houston Chronicle report.
According to Nelson, it was sheer chance that the child was discovered and given assistance. Considering that we are in the midst of summer in Houston, Texas, and with the current high temperature posing a risk to the child, I have decided to establish the bail for this case at $90,000.
According to documents, the prosecution asked for a bail of $150,000, while the public defender of Cux-Ajtzalam requested a bail of $7,500.
According to records, although Cux-Ajtzalam’s bail was established at $90,000, Immigration and Customs Enforcement (ICE) has imposed a restriction on her freedom. At this moment, she is being held in custody at the Harris County Jail and is set to make an appearance in court on Monday.
