Arrest Made: Texas Man Accused of Raping 5-Year-Old Detained by US Marshals

Round Rock, Texas –

Mexican national Fabian Toribio-Martinez, 25, was apprehended in Round Rock, Texas, by US Marshals on Wednesday on charges of child rape.

Federal and local agencies joined together to form the Lone Star Task Force, which was activated on June 20, 2023, after Toribio-Martinez was named to the Texas 10 Most Wanted Criminal Immigrants list. Their goal is to capture him.

“The quick response and dedication of the U.S. Marshals and our law enforcement partners have ensured a child predator is off the streets and can no longer pose a threat to our community,” Deputy U.S. Marshal Reginald Nixon said.

The Travis County warrants that Toribio-Martinez was wanted on were two years old: one for cocaine possession in October 2023 and another for the alleged rape of a 5-year-old girl in January 2024. His 2018 arrest and conviction resulted in his deportation from the US.

Medical exams and forensic interviews uncovered additional severe facts of penetrative assault, according to the Austin Police Department.

The victim’s mother had complained that Toribio-Martinez had handled her daughter improperly, and the incident was further escalated after that. A warrant for the defendant’s arrest was issued for “super” aggravated sexual assault on a minor.

Toribio-Martinez was apprehended and lodged in the Williamson County Jail without a hitch inside an apartment building on Round Rock’s East Palm Valley Boulevard.
